Migración probatoria: informes psicológicos de familia como prueba en el proceso penal chileno
Resumen
Este trabajo examina el traslado de informes psicológicos y sociofamiliares desde los tribunales de familia chilenos hacia el proceso penal, y establece bajo qué condiciones ese traslado resulta admisible. Se empleó un diseño cualitativo, exploratorio y descriptivo, basado en revisión documental crítica de tres corpus: la literatura internacional sobre testimonio infantil y evaluación de credibilidad, la doctrina y los estudios empíricos chilenos sobre prueba pericial, y las fuentes normativas nacionales vigentes. Los hallazgos indican que el problema no radica principalmente en la competencia de los profesionales intervinientes, sino en una transposición de finalidad: instrumentos diseñados para decidir sobre protección terminan empleándose para acreditar responsabilidad penal, sin control previo de su aptitud para ese uso. Se identificaron cuatro condiciones agravantes: la falta de registro literal de las entrevistas anteriores a la que regula la Ley 21.057; el uso de la expresión diagnóstico de abuso sexual, carente de sustento psicométrico; la aplicación de técnicas de análisis de contenido sobre relatos ya intervenidos; y la lectura de la convergencia entre informes como corroboración independiente donde hay dependencia informacional. Se proponen diez estándares de admisibilidad. El rigor metodológico protege a la vez el debido proceso y el interés superior del niño.
